General Promotion Terms and Conditions

Applicability

These General Promotion Terms and Conditions apply to every promotional game of chance, prize draw and competition (hereinafter referred to as: “Promotion”) offered by Musicstation.be. For each Promotion, it will be stated on the website if additional conditions for participation apply. If specific rules are drawn up for a Promotion, those rules shall be considered supplementary to these General Promotion Terms and Conditions.

Promotion Period

A participant may participate in a Promotion during the promotion period. This promotion period is stated with the Promotion. Musicstation.be reserves the right to terminate or extend a Promotion early. A change to the promotion period will be announced publicly.

Participation

For each Promotion, the website will state how participation in the Promotion is possible. Each Promotion may be entered once. If a participant in a Promotion is under 16 years of age, confirmation from their parent or guardian must be obtained in order to participate in the relevant Promotion. Musicstation.be will request confirmation of this consent.

Prizes

For each Promotion, it will be stated which prizes and how many prizes can be won. The prize is awarded in the condition in which it is. Musicstation.be is not liable for any visible or hidden defects in the prize, nor for any damage during delivery (shipping) of the prize. A prize to be won is strictly personal and non-transferable. A prize cannot be exchanged for money, goods and/or services.

Determination of the Winners

For each Promotion, the winners will be selected by an independent person or computer program that randomly selects the winners. One draw will take place per Promotion, unless otherwise stated.

Announcement of Winners

The winners will be notified by email or telephone of the prize won using the correspondence address, email address or telephone number provided by the participant. No correspondence can be entered into regarding the result. Within a few weeks, the prize won will be sent to the winner by post or email or, if this is included in the Promotion terms and conditions or if this is necessary due to the nature of the Promotion and/or the prize, personally handed over to the winner. If the winner does not accept the prize won within three months, their right to receive the prize will expire. Musicstation.be can under no circumstances be held responsible for the participant providing an incorrect telephone number, email address or home address.

Participants who do not win a prize will not be informed.

Exclusion from Participation

Employees of Musicstation.be and everyone who is directly or indirectly involved in the organisation of the Promotion are excluded from participation. Musicstation.be is at all times entitled to exclude participants from participation without giving a reason. Musicstation.be may at any time disqualify and/or exclude a participant from participation if the participant acts in any way contrary to the General Promotion Terms and Conditions, the specific conditions relating to the Promotion, or otherwise acts unlawfully towards Musicstation.be or third parties. Participants with a postal address outside Belgium are excluded from participation. Participants under 16 years of age who do not have permission from their parent or guardian are also not entitled to participate in a Promotion.

Liability

Musicstation.be,and their subsidiaries are not liable for damage resulting from the use by participants/winners of any prize supplied by Musicstation.be, unless Musicstation.be is liable under the applicable provisions relating to product liability. In addition, any printing, game, typesetting or other similar errors in material and/or programs published by Musicstation.be, of whatever nature, cannot be invoked against Musicstation.be, and their subsidiaries and cannot in any way create an obligation for Musicstation.be.

Amendment of Promotion Terms and Conditions

Musicstation.be reserves the right to amend the General Promotion Terms and Conditions and the terms and conditions of the specific Promotion, without prior announcement or subsequent notification. A revised version of the terms and conditions will be placed on Musicstation.be as soon as possible, stating the date of the amendment, or will otherwise be communicated.

Privacy

Musicstation.be handles personal data with care and acts in accordance with the General Data Protection Regulation (hereinafter referred to as: “GDPR”). The current privacy policy of Musicstation.be can be consulted [here].

By participating, the participant acknowledges being aware of the processing of personal data for the purpose of carrying out the Promotion and awarding the prize and agrees to the privacy policy of Musicstation.be.
